Chemical Product Labeling in Canada… Are You in Compliance?


If you sell chemical products that do not comply with Canada’s labeling regulations, you could be involved in a costly product recall or face fines and other ramifications. Enforcement is not limited to the manufacturers; distributors and retailers may be cited and fined if they are distributing and selling non-compliant products for use in Canada. Products labeled in compliance with the requirements of the United States or other countries, might not be compliant under Canada’s regulations.**

Consumer Products must comply with the Consumer Chemicals and Containers Regulations2001 (CCCR 2001). Chemical products must be evaluated to determine if they meet the definition of hazard classes under the CCCR 2001. If they do, the product must be properly labeled with corresponding hazard symbols and prescribed warning statements and may require child-resistant packaging. If a product is determined to be extremely hazardous it may be banned from consumer sale under CCCR 2001. Additionally, all required information must be in both English and French-Canadian.

Workplace Products must comply with the Workplace Hazardous Materials Information System (WHMIS) requirements of the Hazardous Products Act. Similar to CCCR, chemical products must be evaluated to determine if they meet the definitions of hazard classes. If they do, the product must be properly labeled with corresponding hazard symbols and prescribed warning statements. Note that WHMIS hazard classes, definitions, hazard symbols and warning statements are different than those of CCCR 2001. All required information must be in both English and French-Canadian. Additionally, workplace products must be accompanied by a WHMIS compliant Safety Data Sheet.
